Hims & Hers is looking for an outstanding Commercial Counsel with deep entertainment, production, and creative industry experience to join our growing, collaborative Legal team. You will have the opportunity to work closely with our Creative, Marketing, and Production teams to negotiate and document a wide range of commercial relationships — from SAG-AFTRA and talent agreements to music licensing, branded content, and production services deals. You will get to work on interesting and novel issues that arise from the intersection of healthcare, consumer brands, and entertainment.

You Will:

  • Review, draft, and negotiate inbound and outbound production and creative agreements, including SAG-AFTRA agreements, talent and performer contracts, crew agreements, production services agreements, and content licensing agreements

  • Review, draft, and negotiate music agreements, including sync licenses, master use licenses, and publishing agreements

  • Review, draft, and negotiate branded content, influencer, and creative agency agreements

  • Advise Creative, Marketing, Production, and Brand teams on legal risks, union obligations, and deal strategy, including advising on AI-related issues such as generative AI tool use, AI-generated content rights, and vendor AI terms

  • Partner with Rights & Clearances to support IP licensing, clearance workflows, and content release processes

  • Review and negotiate information security agreements such as data processing agreements (DPA) and business associate agreements (BAA) where relevant to production workflows

  • Assist with Hims & Hers' contracting process and help implement scalable policies and procedures for production and creative contract management

You Have:

  • Juris Doctor from an ABA-accredited law school

  • Active bar membership in at least one US jurisdiction

  • 5+ years of experience practicing at a law firm and/or in-house, with no less than 4 years working in entertainment, production, or creative commercial transactions

  • Experience drafting and negotiating a variety of production and creative agreements, including SAG-AFTRA agreements, talent contracts, production services agreements, music licensing agreements, and branded content or influencer agreements

  • Familiarity with SAG-AFTRA union rules, signatory obligations, and low-budget/new media agreements

  • Experience drafting and negotiating IP licensing and content clearance agreements

  • Familiarity with AI-related legal issues in a creative or marketing context, including generative AI use policies, AI-generated content ownership, and negotiating AI-related provisions in vendor and platform agreements

  • Experience drafting and negotiating information security agreements such as DPAs and BAAs

  • Ability to adapt quickly in a dynamic, fast-paced environment with shifting priorities

  • Excellent communication skills and proven ability to provide clear, business-minded legal advice to cross-functional teams

  • Proven ability to balance legal risks with business objectives

  • Team-oriented mindset and positive attitude

  • Ability to provide solution-focused advice

Preferred Experience:

  • Experience working at a production company, entertainment studio, talent agency, or in-house at a consumer brand with an active content/production operation

  • Experience working with music publishers, record labels, or in sync licensing

  • Experience working in a fast-paced technology company, start-up, or direct-to-consumer brand

  • Experience advising on AI tools and platforms used in creative production, marketing, or content workflows (e.g., generative image/video/audio, AI-assisted editing, synthetic media)

  • Familiarity with HIPAA and healthcare-adjacent regulatory considerations a plus
